We strive to offer visitors to Our Website the many advantages of internet technology and to provide an interactive and personalized experience. We may use personally identifiable information, meaning your name, email address, street address, and telephone number, subject to the terms of this Privacy Policy.
This Privacy Policy explains what personal information Factive Nautics Chad E Cooper FNCEC, LLC, doing business as SIRV Institute ("We," "Us," "Our"), collects through www.sirvinstitute.com, www.chadecooper.com, and Our member portal and AI Voice Agent Services, and what We do with it. It should be read together with Our Terms and Conditions.
Our Services are intended only for individuals who are 18 years of age or older. See Children and Eligibility below.
Information you give Us directly. Name, email address, phone number, mailing address, and payment information when you register for an account, purchase a Service, complete a form, enter a contest, sweepstakes or giveaway, subscribe to communications, or contact Us. Any information you choose to share during a coaching engagement or an AI Voice Agent session.
Information collected automatically. When you visit Our Website, Our servers and service providers may log standard technical information including your IP address, the name of your internet service provider, browser type and version, device and operating system information, referring pages, and the pages you visit on Our site. This is collected through server logs, cookies, and similar technologies as described under Cookies and Tracking below.
AI Voice Agent session data. If you use an AI Voice Agent, We collect a transcript of the session, and, depending on Our current configuration, an audio recording. See AI Voice Agent Services below for what is currently retained and for how long.
The collection of information, and combination with previously collected information, to select and deliver content for you, and to measure the delivery and effectiveness of such content. This includes using previously collected information about your interests to select content, processing data about what content was shown, how often or how long it was shown, when and where it was shown, and whether the you took any action related to the content, including for example clicking on content. This does not include personalization, which is the collection and processing of information about your use of this service to subsequently personalize content and/or advertising for you in other contexts, such as websites or apps, over time.
Some Services include interactive sessions with artificial intelligence voice agents. This section describes how We handle the data those sessions create. The consent you give, and the eligibility rules that apply, are set out in the AI Voice Agent Services section of Our Terms and Conditions, which forms part of this Policy by reference.
What is recorded. Sessions are transcribed. Whether audio is also retained depends on Our current privacy configuration for the specific AI Voice Agent, which We may change from time to time. As of the date of this Policy, audio recording is disabled for Our AI Voice Agents and only the text transcript is retained.
Who processes it. Session data is processed by Our voice AI technology provider and, in turn, by the large language model providers that provider uses to generate responses. Those providers are contractually prohibited from using your session content to train their models.
How long it is kept. Transcripts are retained for a limited period tied to the purpose of the session, currently ninety days from the date of the session, after which they are deleted. Any audio, on any AI Voice Agent where audio retention is enabled, is subject to the same or a shorter period. Backups of deleted data may persist for a short defined period, currently up to thirty days, after which they are not recoverable. Certain limited technical logs used for debugging, abuse prevention, or security may be retained separately from the transcript itself.
Requesting deletion. You may request deletion of a specific session's data at any time using the contact details below. We will action a verified request without undue delay.
We share personal information with the following categories of service providers, each acting on Our behalf and under contractual obligations to protect it:

In some circumstances We may not be able to notify you before such a disclosure.

Our lawful basis for account and payment information is performance of Our contract with you. Where We process information for security, fraud prevention, or to improve the Services, We rely on Our legitimate interests, balanced against your rights.
Where the Personal Information Protection and Electronic Documents Act or an equivalent provincial statute applies, We collect, use, and disclose your personal information only with your knowledge and consent and only for the purposes described in this Policy. The Services are not directed to, and are not intended for use by, anyone under 18 years of age. We do not knowingly collect personal information from anyone under 18. If We learn that We have collected personal information from someone under 18, We will delete it.
We use reasonable administrative, technical, and physical safeguards designed to protect your personal information. No method of transmission or storage is completely secure, and We cannot guarantee absolute security.
This Policy is governed by the laws of the State of Florida. We are controlled, operated, and administered entirely within the State of Florida. Disputes relating to Our handling of your personal information are subject to the dispute resolution provisions in Our Terms and Conditions.

By purchasing a Service, you agree that you are foregoing the right to claim a refund of fees paid, except as required by law or as set out below for buyers in the European Union and United Kingdom.
We provide coaching, AI Voice Agent sessions, and related services only, and We guarantee no specific result. We make no promise or representation that you will achieve any particular outcome, and any results discussed on this Website or Our related social media reflect individual experiences that will vary. You are responsible for paying the shipping costs of returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from that refund.

Sale items. Only regular priced items may be refunded. Sale items cannot be refunded.
Digital Services, including memberships, courses, and AI Voice Agent access, are delivered electronically and are not returnable. No physical return applies. Refund eligibility for these is governed by the general policy above and by the European Union and United Kingdom section below.
If you are purchasing from the European Union or United Kingdom, consumer law gives you a fourteen day right to withdraw from a distance contract. Because Our AI Voice Agent Services begin delivering value immediately once a session is available to you, We ask you to expressly acknowledge, at checkout, that access should begin immediately and that you understand the consequence described below.
If you withdraw within fourteen days after making that acknowledgment, you will be charged in proportion to the Services actually supplied to you before you withdrew, rather than in full. For example, if your package includes three sessions and you withdraw after completing one, you will be refunded for the two sessions not yet delivered.
This section applies only where the checkout acknowledgment described above was presented and completed. It does not apply to purchases made from the United States or other jurisdictions where no such right exists, and it does not expand any other right described in this Policy.
Individual coaching agreements may be terminated on 45 days' written notice, and remaining payment billing periods within that notice period will still be due. Termination must be submitted in writing by postal mail or email, per the termination procedures in Our Terms and Conditions.
Group coaching membership offers no refund or cancellation once purchased.
